The Law on Amendments of the Law on Companies was adopted in June 2018. This Law includes a number of novelties and at the same time harmonizes domestic legislation with EU legislation.
One of the adopted novelties was the obligation to register an e-mail.
Until the start of application of these amendments, e-mail registration was regulated as an option, not an obligation. Now, in accordance with Article 21 of the Law it is regulated that the company is obligated to have an e-mail address, registered in accordance with the law on registration. This provision is in effect as of 1 October 2018, and the application deadline is one year. So, by 1 October 2019 at the latest, you should register an e-mail in the BRA.
Also, in the future, the decisions on forming branches and decisions on forming representative offices of a foreign company will have to include an e-mail.
Article 158. of the Law on Amendments prescribes the obligation for
that did not register an e-mail. All of these subjects must register such an address within one year from the date of application of this Law.
All existing companies, entrepreneurs, representative offices and branches of foreign companies must register an e-mail address by 1 October 2019.
Specifically, you need to fill the General Application and Addendum 16 (for entrepreneurs) that is General Application and Addendum 31 (for LLCs).
Current version of these forms can be downloaded from the BRA web page. At the moment of writing this article, the BRA web page includes Addendum 31 and Addendum 32, both used to change e-mails/web addresses/contact data.
Submit the documentation to BRA (in person or by mail). Registration of the e-mail address to BRA is free of charge, therefore, data change fee is not charged, as the case may be with other data reported to BRA (for example, company seat change).
